Spr\u00e1vne pochopenie t\u00fdchto rozdielov je nevyhnutn\u00e9 pri nastavovan\u00ed financovania, ochrane rodinn\u00e9ho majetku a pri vyjedn\u00e1van\u00ed podmienok s bankou.<\/p>\n<h2>Z\u00e1kladn\u00e9 defin\u00edcie a podstata z\u00e1v\u00e4zkov<\/h2>\n<ul>\n<li><strong>Spoludl\u017en\u00edk<\/strong> je osoba, ktor\u00e1 <em>spolu s hlavn\u00fdm dl\u017en\u00edkom<\/em> uzatv\u00e1ra \u00faverov\u00fa zmluvu a zav\u00e4zuje sa spl\u00e1ca\u0165 \u00faver v celom rozsahu. V bankovej praxi ide typicky o partnera, man\u017eela\/man\u017eelku alebo podnikate\u013esk\u00e9ho partnera. Z\u00e1v\u00e4zok b\u00fdva spravidla <em>solid\u00e1rny<\/em> (spolo\u010dn\u00fd a nerozdielny): banka m\u00f4\u017ee vym\u00e1ha\u0165 cel\u00fa poh\u013ead\u00e1vku od ktor\u00e9hoko\u013evek z dl\u017en\u00edkov.<\/li>\n<li><strong>Ru\u010dite\u013e<\/strong> (garant) ne\u010derp\u00e1 \u00faver, ale <em>zaru\u010duje sa<\/em> banke, \u017ee ak dl\u017en\u00edk nespln\u00ed dlh, spln\u00ed ho ru\u010dite\u013e. Ru\u010dite\u013esk\u00fd z\u00e1v\u00e4zok b\u00fdva spravidla <em>akcesorick\u00fd<\/em> (z\u00e1visl\u00fd od hlavn\u00e9ho dlhu) a \u010dasto <em>subsidi\u00e1rny<\/em> (banka sa najprv obracia na dl\u017en\u00edka, no zmluvne si vie vym\u00f4c\u0165 aj priamu v\u00fdzvu ru\u010dite\u013eovi).<\/li>\n<li><strong>Z\u00e1lo\u017eca<\/strong> je vlastn\u00edk majetku (napr. nehnute\u013enosti), ktor\u00fd d\u00e1va majetok do <em>z\u00e1lohu<\/em> na zabezpe\u010denie \u00faveru. Z\u00e1lo\u017ecom m\u00f4\u017ee by\u0165 dl\u017en\u00edk, spoludl\u017en\u00edk, ale aj tretia osoba, ktor\u00e1 <em>nie je<\/em> \u00fa\u010dastn\u00edkom \u00faverovej zmluvy. Pri neplnen\u00ed z\u00e1v\u00e4zku m\u00f4\u017ee d\u00f4js\u0165 k <em>spe\u0148a\u017eeniu z\u00e1lohu<\/em> (predaj nehnute\u013enosti, dra\u017eba) na \u00fahradu dlhu.<\/li>\n<\/ul>\n<h2>Pr\u00e1vny a zmluvn\u00fd r\u00e1mec v praxi b\u00e1nk<\/h2>\n<p>Banky opieraj\u00fa svoje procesy o ob\u010dianskopr\u00e1vne a obchodnopr\u00e1vne predpisy a o intern\u00e9 metodiky riadenia rizika. Zmluvy o \u00favere, ru\u010dite\u013esk\u00e9 vyhl\u00e1senia a z\u00e1lo\u017en\u00e9 zmluvy b\u00fdvaj\u00fa \u0161tandardizovan\u00e9, no \u010dasto obsahuj\u00fa \u0161pecifick\u00e9 klauzuly: zr\u00fdchlen\u00e1 splatnos\u0165, zmluvn\u00e9 pokuty, poradie uspokojenia verite\u013ea, poistn\u00e9 povinnosti pri nehnute\u013enostiach a informovanie z\u00e1lo\u017ecu o podstatn\u00fdch skuto\u010dnostiach. Ka\u017ed\u00e1 rola podpisuje in\u00fd s\u00fabor dokumentov a podlieha odli\u0161n\u00fdm hodnotiacim krit\u00e9ri\u00e1m banky.<\/p>\n<h2>Rozsah zodpovednosti: kto \u010do riskuje<\/h2>\n<ul>\n<li><strong>Spoludl\u017en\u00edk<\/strong>: nesie <em>pln\u00fa a priamu<\/em> zodpovednos\u0165 za spl\u00e1canie, identick\u00fa s hlavn\u00fdm dl\u017en\u00edkom. Pri z\u00e1lo\u017enom pr\u00e1ve sa verite\u013e uspokojuje zo z\u00e1lohu pod\u013ea dohodnut\u00e9ho poradia a procesn\u00fdch pravidiel (not\u00e1rska z\u00e1pisnica, zmluvn\u00e1 dra\u017eba, exeku\u010dn\u00fd titul).<\/p>\n<h2>Vplyv na bonitu, LTV, DTI a DSTI<\/h2>\n<ul>\n<li><strong>Spoludl\u017en\u00edk<\/strong>: jeho pr\u00edjmy sa <em>pripo\u010d\u00edtavaj\u00fa<\/em> k hodnoteniu bonity, no z\u00e1rove\u0148 sa mu <em>zapo\u010d\u00edtava<\/em> cel\u00fd dlh a spl\u00e1tka do ukazovate\u013eov zadl\u017eenia (DTI\/DSTI). Pri ru\u010den\u00ed a spoludl\u017en\u00edctve m\u00f4\u017ee banka po\u017eadova\u0165 aj \u017eivotn\u00e9 poistenie vybran\u00fdch os\u00f4b. Z\u00e1lo\u017eca \u010dasto podpisuje povinnos\u0165 udr\u017eiava\u0165 majetok v riadnom stave, plati\u0165 poistn\u00e9 a umo\u017eni\u0165 banke kontrolu.<\/p>\n<h2>Poradie verite\u013eov a druh\u00e9 z\u00e1lo\u017en\u00e9 pr\u00e1va<\/h2>\n<p>Ak u\u017e na nehnute\u013enosti viazne z\u00e1lo\u017en\u00e9 pr\u00e1vo, nov\u00e9 zabezpe\u010denie sa zapisuje v porad\u00ed. Prv\u00e9 z\u00e1lo\u017en\u00e9 pr\u00e1vo m\u00e1 prednos\u0165 pri uspokojovan\u00ed. Druh\u00e9 z\u00e1lo\u017en\u00e9 pr\u00e1vo je mo\u017en\u00e9, ale pre banku rizikovej\u0161ie \u2013 \u010dasto to zni\u017euje maxim\u00e1lnu v\u00fd\u0161ku \u00faveru alebo zhor\u0161uje \u00farokov\u00e9 podmienky.<\/p>\n<h2>Odchod zo z\u00e1v\u00e4zku: uvo\u013enenie spoludl\u017en\u00edka, z\u00e1nik ru\u010denia, zru\u0161enie z\u00e1lo\u017en\u00e9ho pr\u00e1va<\/h2>\n<ul>\n<li><strong>Spoludl\u017en\u00edk<\/strong> m\u00f4\u017ee by\u0165 uvo\u013enen\u00fd len <em>so s\u00fahlasom banky<\/em>, typicky po refix\u00e1cii\/refinancovan\u00ed alebo po prepo\u010dte bonity zost\u00e1vaj\u00faceho dl\u017en\u00edka.
