Banku nezauj\u00edma, kto byt re\u00e1lne u\u017e\u00edva alebo kto sa ods\u0165ahoval \u2013 d\u00f4le\u017eit\u00e9 je, aby pri\u0161la v\u010dasn\u00e1 spl\u00e1tka a bolo dodr\u017ean\u00e9 zabezpe\u010denie (z\u00e1lo\u017en\u00e9 pr\u00e1vo). Preto treba rie\u0161i\u0165 tri navz\u00e1jom prepojen\u00e9 roviny: (1) vlastn\u00edctvo nehnute\u013enosti, (2) zodpovednos\u0165 za dlh a (3) praktick\u00fa udr\u017eate\u013enos\u0165 spl\u00e1cania a b\u00fdvania.<\/p>\n<h2>Spolo\u010dn\u00e1 hypot\u00e9ka \u2260 spolo\u010dn\u00e9 vlastn\u00edctvo: rozl\u00ed\u0161te r\u00e1mec<\/h2>\n<p>Pri rozchode si najprv ujasnite, v akom re\u017eime nehnute\u013enos\u0165 vlastn\u00edte:<\/p>\n<ul>\n<li><strong>BSM (bezpodielov\u00e9 spoluvlastn\u00edctvo man\u017eelov)<\/strong> \u2013 t\u00fdka sa majetku nadobudnut\u00e9ho po\u010das man\u017eelstva, pokia\u013e nebolo z\u00fa\u017een\u00e9\/roz\u0161\u00edren\u00e9 alebo zru\u0161en\u00e9. Pri rozvode nasleduje vyporiadanie BSM.<\/li>\n<li><strong>Podielov\u00e9 spoluvlastn\u00edctvo<\/strong> \u2013 presn\u00e9 podiely (napr. 1\/2 a 1\/2) pod\u013ea LV; \u010dast\u00e9 pri partneroch bez sob\u00e1\u0161a alebo pri vklade r\u00f4zne ve\u013ek\u00fdch vlastn\u00fdch zdrojov.<\/li>\n<li><strong>Jeden vlastn\u00edk + dvaja spoludl\u017en\u00edci<\/strong> \u2013 v praxi sa vyskytne, ak banka \u017eiadala dvoch dl\u017en\u00edkov kv\u00f4li pr\u00edjmom, no byt je len na jedn\u00e9ho.<\/li>\n<\/ul>\n<p>D\u00d4LE\u017dIT\u00c9: Pri \u00favere ste vo\u010di banke obvykle <em>solid\u00e1rni dl\u017en\u00edci<\/em>. Ka\u017ed\u00fd z v\u00e1s ru\u010d\u00ed za cel\u00fd dlh, nie len za \u201esvoj podiel\u201c.
